    Hello,
I live in Iroquois County, our County Board wants to Cut our Sheriff’s department by 23%. It would mean another loss of 5-6 Deputies and we’re down 5 already, so it would leave Us with 6 Deputies to Patrol the 3rd largest County in the State of Illnios. Since this is almost all rural and it takes 30-90 mins depending on where their at now to respond to a 911 call ,I want to know “Can I confront an intruder on my land if I’m in my Tool Shed with my Side Arm, or Shotgun or catch them Stealing from me ??? I’m a Disabled Vet, Gulf War Veteran . I have training from my years in the Service with Fire Arms.I do carry a side arm “Open Carry” on my land right now do to the Coyotes and “Nosey People that pass by on our “Basicaly Deserted area Road”. I also have 2 dogs that would be my first line of Defense, plus camers.
But if the County Board doesn’t get their half cent saftey tax passed in Feb 2010 , we’ll be without Law enforcement for the most part.
    What are my “Legal Rights”??

    Thank-you

    Edward,
You need to look into your state laws considering self defense. I believe your liabilities would be tested if you shoot someone that is stealing from you other than if they are doing it in a way that threatens your life. All states have their own laws governing self defense. Ours used to be you have to be in the most rear part of your house and must be at the last resort before you can shoot an intruder. Recently that had been changed to as long as the intruder is in your house uninvited and showing agression. I also open carry on some recreation land that I own. I have seen bear prints which I am not to worried about. The ones I do worry about are the two legged ones that may decide that I am easy prey way out in the middle of the woods. Again I have to be careful to make sure that I am in life threatening situtation before I even unholster my gun. I do know how you feel as I had a situation where i had to call the sherrif and it took them 35 minutes to get to the front of my property… Best of luck to you and hope things change for the better.

    Thanks

Edward, I’m taking a NRA Protection in the Home Class. The instructor said that Illinois has some of the best laws in the U.S. concerning defending yourself in your home. No need to retreat. If you defend yourself against someone in or outside your home committing a forceable felony you can’t be sued in court by him, his family or estate. You can’t use your firearm if someone is just taking property, but if you are defending yourself or another that is entirely justifiable. I think it mentions fear of death or bodily harm.

Edward, might I suggest calling a concealed carry trainer that might be familiar with the laws in your state. The only one I have experience with is http://www.equip2conceal.com and they offer firearms training in Iowa, Wisconsin, Colorado and Florida. Good luck.

What about NEW YORK???? We have laws that are just plain STUPID! I had to wait almost 1 year for my “sportsman” permit to be ok’ed . I am squeaky clean, my background is beyond reproach, YET I have to prove I NEED a CCW piece of paper to protect myself and mt family, while the dirtbags can do what they want! I live 100 miles east of NYC and it seems the bad guys are hunting US !!!!! Who is out there helping the taxpaying Homeowner PROTECT OUR RIGHTS. I live in the 1st Congressional District and have written letters to everyone on this matter! Any help on how I get my PAPER upgraded is WELCOME!
